The website rocafish.com and the Rocafish platform are owned by International Trading Fishery S.L., with Spanish Tax ID B88227277, registered address at C/Comino nº4, C.P. 35212 – Telde, Las Palmas, Spain and contact email alexisperez@rocafish.com.
2. Purpose of these terms
These General Terms Phase 1 govern the initial use of the website, public forms, contact requests, pre-registration requests and Rocafish’s internal initial assessment of companies or professionals interested in the platform.
These terms do not yet govern professional activation, operational access to private panels, participation in operations, signature of master agreements, signature of specific buyer-seller contracts or execution of B2B operations.
3. Nature of Rocafish in Phase 1
During Phase 1, Rocafish acts only as an informational website and as a channel for receiving professional requests.
Rocafish does not act as buyer, seller, importer, exporter, carrier, freight forwarder, customs agent, payment entity, payment service provider, holder of funds, financier, insurer, guarantor or legal, tax, customs, health, technical or financial adviser.
4. Target audience
Rocafish is mainly addressed to companies, professionals, buyers, sellers, vessel owners, producers, B2B operators and persons acting on behalf of entities or professional activities related to fisheries, seafood, international trade, logistics, inspection, distribution or related activities.
5. Phase 1: pre-registration and initial request
Phase 1 includes browsing the website, consulting public information, submitting forms, accepting applicable legal texts, internal receipt of the request, initial review and possible follow-up contact by Rocafish.
Phase 1 does not imply professional activation and does not allow the user to operate within Rocafish.
6. No automatic activation
Submitting a request or form does not imply automatic acceptance by Rocafish.
The applicant does not acquire, merely by submitting a form, any right of access to private panels, right to participate in operations, right to publish offers or requests, right to contact other users through the platform, right to sign operations or right to be approved in KYB/KYC processes.
7. Acceptance of these terms
By submitting a form, contact request or pre-registration request, the user declares that they have read and accepted these General Terms Phase 1, as well as the Privacy Policy and, where applicable, the Cookies Policy.
8. Data provided by the applicant
The applicant undertakes to provide true, up-to-date, complete and non-misleading information. When acting on behalf of a company, organisation or third party, the applicant declares that they have sufficient authorisation to provide information, submit requests and maintain communications with Rocafish on behalf of that entity.
9. Internal review of requests
Rocafish may internally review requests received to assess identity, contact details, company or activity represented, country, market, professional profile, type of product or commercial need, suitability for the B2B approach, operational feasibility and documentary, commercial or technical risks.
The internal review does not constitute advice, certification, audit, guarantee or final validation of the applicant.
10. Rocafish’s right to reject or pause requests
Rocafish may accept, reject, pause, archive, limit or discontinue a request whenever it considers appropriate based on internal, operational, documentary, commercial, technical, risk, compliance or feasibility criteria.
11. Phase 1 communications
Rocafish may contact the applicant to answer queries, confirm receipt, request additional information, expand details, inform about the general status of the request or explain later phases.
Rocafish does not currently operate a general newsletter. Phase 1 communications are professional, operational or related to B2B request follow-up.
12. Data protection
The processing of personal data provided during Phase 1 is governed by Rocafish’s Privacy Policy.
13. Cookies and technical services
The use of cookies, similar technologies, analytics, security, reCAPTCHA, Google Analytics, Google Tag Manager, Cloudflare or other technical services is governed by Rocafish’s Cookies Policy and Privacy Policy.
14. Later phases
If Rocafish decides to continue with a request, the applicant may be invited to proceed to later phases, which may include additional business information, documentary verification, KYB/KYC, internal validation, signature or acceptance of a master agreement, professional activation, access to private functionalities, participation in specific operations or signature of specific documents.
Progression to later phases is not automatic and will depend on Rocafish’s decision and compliance with the applicable requirements at each time.
15. No binding offer or operational commitment
The information published on the website or sent during Phase 1 is general, informational and preliminary.
No public content, form, initial communication or pre-registration constitutes, by itself, a binding contractual offer, final commercial acceptance, commitment to complete operations, promise of available buyers or sellers, guarantee of price, volume, quality, delivery or payment, authorisation to operate on the platform or specialised professional advice.
16. Permitted use of the website
The user must use the website lawfully, diligently and in good faith. It is prohibited to submit false information, impersonate identities, act without authorisation on behalf of third parties, enter third-party data without sufficient basis, use the website for fraudulent purposes or attempt to access private areas without authorisation.
17. Documents sent by the user
The user is responsible for any documentation, information, messages or files sent to Rocafish. The user should not send confidential, sensitive, unnecessary or third-party information unless it is relevant, authorised and necessary for the request.
18. Relationship with other legal texts
These General Terms Phase 1 are supplemented by the Legal Notice, Privacy Policy, Cookies Policy and any specific documents that may apply in later phases.
19. Governing law and jurisdiction
These terms are governed by applicable Spanish law. For any dispute related to the use of the website, forms or Phase 1 pre-registration, the parties submit to the Courts and Tribunals of Las Palmas de Gran Canaria, unless mandatory law provides otherwise.
